Then sell it and take advantage of the $250k (single) /$500k (married) 121 exclusion as well (which is even better than 1031 in that your gain is tax-free not merely tax-deferred) as well as 1031 if your gain is in excess of $250k/$500k.

Unless you are merely trying to create a diverse portfolio of average yielding property investments, you need to do better than investing in properties at “market value”.  

Under the Fair Housing Ammendments Act of 1988, the latter is merely a subcategory of the former.

I've seen properties literally sell in mere days for double what an identical property two blocks away may have been priced at and not sold for months, just because one property was on a "better block" than others. 

It's like the guy who say they own 12 doors or own 4 apartment complexes, when in fact they're merely a 3% to 5% investor in these products.

Since this is more of a "house hack" and they're merely renting a room, it isn't illegal per se but you would do well to protect yourself from liability in the event of a tragedy.
