If the cost of his misunderstanding is large enough, you need to take the case to Appeals (where the IRS people are significantly more competent) and ideally hire representation or at least pay someone knowledgeable for a consultation.But I'm not sure WHY his misunderstanding would cost you anything in SE tax.
