Your title officer will tell you what they require.I'm not aware of a document in any jurisdiction named 'Probate Deed'.There is a personal representative deed, administrator deed and executor deed, all of which are used to distinguish from grant deed or warranty deed in that the transferor cannot represent what they don't know, since they are acting in purely fiduciary capacity

I would say that the hard money lender's only real liability concern should be in dealing with capacity issues of the borrower and standard fare contract litigation.

They also operate like a business: you do not get into a 100 unit apartment complex thinking you are going to do it yourself, you hire staff (or outsource to a professional management company).In hind sight, if I were starting over, I'd never have bought anything smaller than 16 - 20 units in the beginning and as time goes by, I'm thinking maybe nothing less than 30 - 50 units.Starting off there may be benefit to work with an experienced operator or syndicator who knows the business ... even if only in an advisory capacity.

The way the system is set up for agents, buyers and sellers allows for order and it is governed, when you remove structure there is chaos and it limits the State's ability to protect the public, which is why I say there will be a need for us well into the future, but the dynamics to how we do business will change in some capacity or another.
