Buyer has accepted but contract not yet fully executed, as many know the way FNMA works is you make the offer, they give you a verbal acknowledgement, then you have 5 days to "formalize" your offer with their REO addendum, then they turn around and execute the contract.This home has some high end stainless steel kitchen appliances, Supra washer dryer combos (two of them), Dorn Bracht faucets, brand new air conditioning units for outside Gazebos, steam shower body jet roman tub modular units, Miele dishwasher, 48" long SS outside BBQ unit, etc etc etc...and because the home was never 100% finished, some of those appliances were not hooked up or installed, they sort of sat in their space but some still had styrofoam wraps around them or manuals taped over them.So, I listed all those in my contract to purchase, where you typically list included items, like ceiling fans, window treatment blah blah blah.The Listing Agent wiped all that out.

Then we make the tenant sign acknowledgments of what our security deposit deductions fees are on a 2 page itemized list, they also have to acknowledge what is required on their part to get the deposit back, per the law.One thing to remember is you are running a business and you have laws you have to abide by and also laws that you are protected under.

I sent @Nixon Vayupak an original, new copy the Gayle Ellison book,'Inside a Probate Sale' as a gift.I presume that he somehow has not received it as most people would have acknowledged receiving, at least as a courtesy.Some time ago I purchased the entire publisher's inventory of the book and rights to same in order to take the info off the market when I was white-hot actively doing probate real estate deals.

I would also suggest that you compile a handwritten list of any repairs and have the tenant walk thru with you to acknowledge such issues occur to help eliminate any nonsense later with them stating that the unit was in a different condition when the vacated.

That the seller, your client, will need to execute documents pertaining to the deficiency....do you mean the seller agreeing to a deficiency or acknowledging that there will be no deficiency?

I've had a couple occasions where the seller or listing agent has had an issue with this, and in those cases I'll generally just pay cash and refinance.But, if they don't say anything, I'll just hook my lender up with my closing attorney, and from what I can tell, the seller and the seller's closing attorney never know (or don't acknowledge) that I've used financing.
