You would have to sue the HOA in order to recover any funds after you've sold the condo, and you would probably have to demonstrate that their incompetence and/or malfeasance created the large budget surplus that you should be entitled to; the money wouldn't come from your new owner, it would just be a judgement against the HOA.

I would structure this so the lease is between you and the tenant, the corporation and an officer are guarantors that gives you three parties to recover from.

This is why Congress set them up to prevent people from pulling the money out until they need it at retirement age and not sooner.The second question is what type of "cookie" you should put into the jar, which means what you should invest in, And if you need the money in three years I would not invest in stocks or corporate bonds or municipal bond funds which could lose significant amounts, but would likely all recover a few years later.
