Now during the crisis the lenders put a moratorium on issuing the 1099C to any owner occ. and many others as they were just over whelmed.. but these as you note that the other person got one.. the banks are now issuing them.what this does is tells the IRS you got debt relief and said amount of debt relief then become ordinary income and you must pay tax on it..

Some banks did offer a little relief, usually 3 months of no payments on the mortgage that were tacked on to the backend, but many people had to wait much longer before being able to get a reputable contractor in to fix their homes.

They would want to deed the house over to you and keep the mortgage in their name for two reasons: 1) they can't make payments anymore (they are defaulted, going into foreclosure, or some type of financial hardship) and are in danger of losing their home, and you would be offering to take over payments right away, so they NEED the relief/help that you are offering; 2) you will be saving their credit.
