My question is, Is LandAmerica liable in this case since they release the deposit without buyers consent.

A transfer to an LLC is a valid reason for a lender to accelerate (or at least threaten) the loan whereas a transfer to an inter-vivos revocable trust is not.

Short version: my tenant (without my consent) tried to fill their own steam boiler, and ended up flooding my entire two family from the top down with dirty water from the radiators leaking through the radiator vents.

But...I haven't seen a lease in the last 5 years that doesn't explicitly discuss short-term rentals like Airbnb, and virtually all of them say they aren't allowed without the owner's consent.
