Be aware, too, that the first mortgage holder is unlikely to give you any information about the loan without an authorization form signed (and maybe notarized) by the borrower.

If what you say is true I'd:A) Hire a lawyer who will likely get a notarized letter from the inspector stating there was no damage as well as scare the heck out of the realtor and potential buyerB) Report the buyer's realtor here: http://www.dre.ca.gov/Consumers/FileComplaint.htmlIf you want to back out of the contract I'd speak with the lawyer first.

I created the Affidavit for myself to show the causes for "service" and complete the foreclosure of the tax sale property.With everything signed, witnessed & notarized I proceeded to have all paperwork filed (recorded) at County Courthouse where properties are located.

@Steven Zai @Vinay H.As mentioned, you have a separate Mortgage/Deed Of Trust document signed, notarized and recorded.....That is what makes the property “secured”, Not the Note, or any contract.
