If you counter-argue that this writeoff is limited by passive loss rules, then I'd say that if you're buying property these days that will generate tax losses, then those are indeed poor purchases.Deprecation recapture, if it occurs due to a sale, is at a lower rate of 25%, so even if you sell you'll pay at a lower rate and will of course have attained the time-value benefits of having received the tax writeoffs in earlier periods.

Or consider this the seller wants an unrealistic price for his buildable lot but he doesnt have time to wait for his buyer Wouldnt he be better of to take part in a Joint Venture deal where a group of investors decide to build a spec house or multi family units,maybe some nice townhomes or a duplex on this building site.The lot owners contribution as a co investor is the lot itself,everyone sits down and they establish a realistic value for the lot ,the buider and architect present a proposal for the plans and cost of construction, a cost for the project is established and an exit strategy,Wouldnt the seller of the lot /s be better offer participating something like this and attaining the target profit he wants to make?

Looking to judge merits of going this route, how easy it is to attain (i.e. what rates to expect from bank, what Loan-to-Value likely to get from a bank, how this impacts Private Mortgage Insurance, how streamlined the process is, etc), so as to help determine whether this makes sense versus a Home Equity Line of Credit, or just selling the property and reinvesting the cash, avoiding the tax of doing the sale by assuming the property I'm selling is either my primary residence or an investment 1031 exchange (in my case, both apply, with different properties)Thank you!
