I'd hire an attorney to draft a settlement and indemnification, return the deposit and eat the costs that he should be paying in exchange for not pursuing damages.If you wanted to throw chin music, you might counter for an amount that puts it out of small claims court and would force him to hire a lawyer but frankly I think that's a check raise with a losing hand.

Having an ear buds only music policy for the workers on site will also help keep the noise level down somewhat- because these guys can place some loud music sometimes when you're not there thinking everybody likes their taste in music.
