If you've set up your structure correctly, the tenant never has privity with the entity that owns the land, and your 'rich' entity can Motion for Summary Judgment or 12b6 out of the lawsuit or whatever early trial dismissal method your jurisdiction implement and you let your shell entity take the lawsuit.

Then with an award of judgement there is additional court fillings to achieve a garnishment, ALTHOUGH it is best to do a motion for discovery prior to that so when come into such, depending on findings of discovery, there may be more then just wage garnishments, such as financial accounts, other assets etc..

The trustee then looks at the facts provided and depending, on when the sub to was performed, if it was hidden in a trust (concealment) or was filed as a normal deeded transaction, the terms and conditions and a lot of other factors like if the payments were being made on time and so on.The trustee would allow the bank to submit a motion to accept the sub to as written or to compel a sale.
