scratch it out and fill with a very flexible caulk - not a painters caulk. it is not wide and looks like a normal settling crack. as far as the fireplace, check where the roof meets the chimney, it may need to be re-flashed and tared also seal where the siding meets the chimney, it does not look like any signs of mildew and can be painted over with some kilz or any primer that will cover stains

As far as holes in the walls, it is unfortunate that some tenants use large nails to hang pictures and they make other holes in the walls for who knows why, but repairing even large holes 12" x 12" inches won't bust your piggy bank because we freshen every unit when a tenant moves with a coat of paint and if you are using a painter worth his weight in salt then he should be able to patch a few very large holes within 1 or 2 hours and the cost for materials should be no less than $30 to not one penny more than $50.You will just waste your time and aggravate yourself by feeling your are a victim and you have been violated.

I just had my painter look at my floors that I am going to repaint and he said oil based is a must on the floor, it'll last a lot longer.

An hourly rate for a painter actually seems to run much closer to $30 / hour than $20 and then you have the extra costs for worker's comp, taxes, SSI tax, any benefits including mandatory health insurance, and unemployment insurance.
