If I go to court and file the unlawful detainer, pay the fees due (not cheap in CA), and serve the tenant and then he decides to pay his rent - will I be able to continue the eviction, or do I have to stop, lose the fees I paid and do it all over again next month?

So know the law, Know your lease and underline it and give a copy back to them, With that said.Yes charge them the $50.00 late rent fee. and If they don't pay you tell them you'll file unlawful detainer eviction action for non-payment of rent , you have no guarantee how they will leave the apartment.

Am I still able to send him an unlawful detainer on the home; he deposited the 1600, but he can go to any wells fargo branch and make a deposit whenever he wants...meaning I didn't "accept' the partial payment, he deposited the 1600 without telling me.Now, it gets weird...When he rented the house (21 months ago), he put himself and his daughter on the lease as people who will be living in the house.

If I file a unlawful detainer and we go to court and she claims that i turned the water off on her and locked her out of the laundry room so she had to get a motel room will I have to pay her up to $100 a day ?
