So I then took them proof of two different incidents, via actually things that were supposed to be swapped but weren't as well as video evidence.  

So that is an issue, you need to see you are not just swapping one risk for another by going llc with an encumbered property (may get rid of some liability risk but introduce financial and loan risk).. best of luck
