You need to understand creditor laws in your state before you can properly evaluate the risk in accepting a tenent in obvious finacial distress.In my opinion, unless you know what you are doing and your state offers anti-defiency protection, you should stay away from prospective tenants in such financial distress.

I'm not trying to be anti-social or anything, but, from time to time, I either do small jobs on the property, inspect the work contractors have done or want go to the property and have a look around (with the PM) and not be bothered.

I've never given it yet.Anyway, I'm going to give them a Notice to Quit to terminate the month to month and give them a new lease with all the unpleasantness I can under the NJ Anti-eviction laws (they require lease renewals and limit rent increases to "not unconscionable").

Here in NJ you need VERY specific language in your leases to collect any late fees as well as court costs Etc...Lease must state that any late and or additional fees are "additional rent" IF this isn't stated Judge and dismiss anty and all fees.Ask me how i know
