I would likely use the equity to purchase more real estate so I might just 1031 into a new propertyCaveat: I am not a CPA, tax professional, lawyer, IRS afficianado or other expert in taxes, but...If you have lived in the property for two of the last five years, you should be able to capture that $100k in appreciation without needing to go through the hassles of a 1031 exhange.

Or can I draft up my own purchase and sale agreement with a real estate lawyer that includes only language that I need for my wholesale deals?

I'm in search of a good land use lawyer who can help me negotiate public infrastructure I am being required to pay for near Waynesville, Ohio (Wayne Twp, Warren County, exurb of Cincinnati/ Dayton) in association with a small subdivision I am constructing.

If there is a law suit yes the lawyer can find you, of course.

Further, the court is empowered to do just about anything it wants or perceives as “fair”.  

I suspect I (my lawyer) would have gotten this rectified in a week or 2.I am glad this seems to be getting resolved but this was via a fortuitous connection made via this post.

He needs to get advice from a lawyer who can advise him on whether to file a legal action or not.
