Once that lease is executed the tenant will not go back and change anything to their advantage.

@Dhru Das@Crystal Smith A clarification; the 90 days is from the execution of the deed to the seller, until the "signing of a purchase contract that results in FHA financing". 

Depends on whether or not you and your seller are both ok with the bank executing the due on sale clause.  

It allows me to lay out a plan to execute,  and then gives me the info I need to monitor progress...but that's just me.

I've seen these types of business arrangements executed before whereby lawyers, therapists, barbers, CPA's, etc establish their businesses in "historical" districts (for lack of a better descriptive) and in some cases live in the same building or in the mother-in-law building out back.

Then when I decide to execute 1031 exchange, I wonder how does my home equity loan impact the value I must carry over to my replacement property?

The only way you'd get a real answer is to go thru the short sale process again.....listed property, executed sales contract, short sale package along with financials submitted by the owner, etc.  

But If the heirs are happy campers the court will give the PR full authority to execute their job to sell assets and pay debts.
