@David Hudson  I know this is a very old thread but I'm finding myself in the same boat - I've tried excluding smokers on a certain low end property and it's excluding every single tenant.

Germaine Act allowing the due on sale clause to be used specifically excludes assignments to any Trust and transfers accomplished for estate planning purposes. :)

Thanks Ryan and Jerry.Jerry,Some counties have Judicial Foreclosure Packet with self help information regarding filing judicial foreclosure.For example http://www.coconino.az.gov/DocumentCenter/View/53These packets exclude partnerships, corporations trustees, and associations, hence my questions regarding special rules.I have been procrastinating for some time between hiring a lawyer for this, but probably will try on my own first.Ohad

Either they were excluded from being presented because they had their own pocket buyers, or they had clued in their buyers as to the number they need to just beat the others...or they had better terms.

@Neil Hauger I don't think there is an actual meeting where your offer is presented, so there's not some event you are being excluded from.

We have to do a lot (over and over again), but since the square footage is so low and the quality of materials is lower, it doesn't add up.Our costs, excluding debt service and the $300 "capital improvement" appliances that will only last a year or two, is 35% of gross rents.
