In other words, if your Association chooses/chose to continually ignore their own bylaws or allow regular disregard for the bylaws, it wouldn't be difficult for your lawyer to essentially render that portion of the bylaws moot in a court of law.

@Anthony Petrarca, Your accountant is so wrong :) First of all, as @Stanley Bronstein said, the 1031 is a federal statute and everything hinges on the tax return that your LLC files or if it is a disregarded entity, your own return.

@Lynn Maher  I would suggest to disregard starting bid amount.It's not relevant.You should calculate what is the highest and best you willing to pay for this property.Depends on with county the auction located, another factor to take into consideration if the bid is PROXY or highest & best.
