I'd remove it, I have one in my yard but would never trust a tenant to maintain it, plus you'll have enough stuff to keep in repair without adding unnecessary things

I also have never "billed" a tenant...if they don't pay rent on time on their own then I text/email/call them and let them know I haven't received it and what their options are (reduced late fee, full late fee, eviction filing, etc.).Being a landlord is hard enough, no sense in causing yourself unnecessary stress by having to drive around collecting rent EVERY month.

I am a title agent and our attorney connections (both staff and non-staffed) would certainly address any questions we had, however, I agree with Dan that probate is still the most effective way to go and will assure that title is clear and that the new owners will have no unnecessary hassles after closing.

If it's a fee paid at closing, it could be a transaction fee to the brokerage, which is fine, although totally unnecessary.
