I think it would be interesting to see how the cited suit is resolved.While a title agent may be comfortable in relying on an affidavit for property with eight heirs in a smaller estate and you might be willing to accept a policy w/o exception because you're insured, I was recently called to testify in a suit filed in a claim I handled five years ago.

As long as you are willing to testify in court that what you verbally agreed to was not to back out and you have a written contract you should be golden as long s the title company is still holding your earnest money.
