After talking with an attorney an honest one will tell you if it's worth your time to pursue or not and if the legal costs will be larger than any amount recovered if ever.It's not just about getting money back it's about the time, energy, and cost to do so and the odds (percentages ) of recovery if you invest the time and money to do so.

One thing you may consider is the Allegheny County Vacant Lot Recovery Program whe the county will wipe out all the liens and sell the property to you at an appraised value.

Not to say that the phrase of saying "promise to pay" is ommitted as that is not, there is the promise to pay the debt created, but that the liability to do so is limited to the recovery and disposal of the collateral secured.Anyway, you could modify an existing note.Another way that may meet your requirement is by an addendum or seperate modification of the note and deed of trust.
