This is a code violation and, according to our inspector (who is really awesome by the way), no electrician who we called to work on the panel would agree to either stand on the unit or perch above it in some wonky manner.

I think if you have that threshold, work with a good inspector and don't over estimate your sales price - then you should be in solid shape.
