But if someone (seller, outside party) is willing to subordinate and carry a junior lien, there is a significantly great ability to fill out the rest of the "capital stack" with a bank loan.

If Thomas were to default on the CMBS loan the old owner and now junior lienholder would have the right to reinstate the senior debt to protect his interest and foreclose Thomas out.If you think about it, it's somewhat of a brilliant strategy on behalf of the seller.

If we do not hear from the homeowners by Jan 4th, my attorney plans to prepare a Trustee's Notice of Sale to be posted at the courthouse, and in the local paper for 4 weeks prior to the auction date.I realize that (hopefully) we will never get to the auction but if for some reason the sellers never decide to communicate on this issue, I have some questions on how to proceed.Does the junior lien post the minimum bid at the amount they are owed only (UPB + Arrears + legal fees) or do they post minimum bid at the amount to cover both the first and second liens?

Oh yeh, the 12 month redemption.....yeh, I'd want a big discount, but then again, you could go buy the redemption rights from the owner....don't know if the junior would have redemption, if not paid off.
