I personally could argue either side, but after years of in-depth experience I've concluded that there is no certain answer to the question of who really pays the commission.If you've ever had the opportunity to list a home as an agent, then you would know that most sellers take on the attitude of "I'm paying the commission, therefore you work for me".

i think you are trying to conclude that whenever these methods are used they are, in fact, fraud. not true. you can creatively finance a deal and not be anywhere close to fraud.this website is full of people who do sub2's and double closings all the time. raise of hands, who's served time?

Insurance in place, is it feasible to insert a clause in a Rental Agreement stating that for example, "Tenants agree that they will bear full responsibility for any damage, whether through negligence, deliberate act or accident, occuring from fire in any fireplace the determination of which shall be concluded forensically through municipal/county/assign-your-jurisdiction fire inspection" or something of the sort?

I concluded it is a really bad idea to rent furnished except for fringe markets (corporate rentals, vacation properties).Some simple examples of the negatives.Lots of inventory to manage and evaluate when changing tenants.

That total sales number of $1.3b for the last quarter seems low.I guess we can conclude that a large proportion is not really active at all.The rest is full time but then the 80:20 rule applies to that portion.So overall I think it is more like 10% do 90% of the deals.Here in Aspen I would say the distribution is a little flatter.

I think my ideas above inlclude more risk than your proposed strategy, but its worth considering and running the numbers even if you conclude that path is not for you.
