Owner occuppied (oo) implies ability for FHA 95% LTV loan (maybe 97% LTV) as well as the most favorable loan terms that are only available oo.

The reason this is important is that it implies that duplexes purchased will be under rent control regulations (assuming a unit is occupied) regardless of if the new owner decides to move in (house hack) after purchasing the property.

Filing the day of/before the sale implies (usually....to me at least) it was a "skinny" filing and has a motion to dismiss attached to it from the court if they don't get the complete filing in in a timely manner.

Since BRRRR is refinancing, that implies you already have a mortgage on the property, so I am sure a given situation would have the opportunity for both strategies.

The person I spoke too didn't use the term "Force Majeure", but it was essentially implied and said they would just push all payments back by one month and that I would still receive all payments.

If he did not outright state that they would ensure the rules were obeyed by the various jurisdictions, I thought he, at a minimum, implied it.I would press HCD for guidance.
