My question is this; if there is currently a mortgage on the property , does structuring your deal this way enable you to avoid the Due on Sale clause because title is not actually transferred?

I've seen them tossed out of court more often than not in favor of what was recorded.Perhaps there are instances where the court invalidated the transfer to the trust and quiets title in favor of the unrecorded qcd, like if the grantor was deemed to have been incapacitated at the time and there's a financial exploitation situation... but that's a rare scenario.

Section by section.Also any personal experiences on strategies used during closing would be great.So far I've learned about:What it means to sell "AS-IS" therefore stating the cost of repairs would be at the buyer's discretion.Also, including the cost of transfer on the seller and buyer, respectively (especially with PA's transfer tax law).I also understand getting both agreements notarized is wise.If there's anything else that I should be aware of, please let me know.Thank you in advance for all your insights!

I've decided to stick it out for at least 6 months before trying to transfer and a year before quitting so as not to burn any bridges.
