If there was no security deposit retained at the start of the lease, you could probably pursue this in small claims court. 

@Kevin Drouillard most PMCs do not pursue collections after a tenant moves out.Check the eviction judgment to see if a money judgment was included.If not, you will need to pursue small claims judgment.Once you have a money judgment you can try to garnish (another court process) wages, bank accounts or state tax refunds.

The landlord ( an alumni of the chapter) tried to evict them but the other brothers in the house didn't enforce it and claimed he was a guest.

If I continue to pay the mortgage in the the seller's name (with out refinancing) would they claim the mortgage interest tax deduction or do I get to claim that since I am paying the mortgage and hold the deed to the property.

I never claimed it as we have offices, but I know many people and accountants which say it is perfectly legal.
