@Dominique Guinnane  thanks   1) keeping the price up is improtant to the seller  ( even if they are parting with the  credit / concession for the  temp buydown )    2)  the  lower  rate  for the  buyer  is enticing  as they  can  get a lower  discounted  rate  for  2 yrs   and then  possibly  refinance to a  permamnent  lower  rate/ payment when and if rates   drop ......thus the  2-1 buydown  can  be  more attractive to all parties  versus   dropping price  by 20K ( usetting seller )  and  having to  see the buyer  complain about taking a higher  payment / rate on the loan

It just so happens that none of the individual expenses exceeded the $2,500 rule even though the aggregate cost to construct a set of cabinets (example) may exceed this threshold.Since 1.263(a)-(f)(6) specifies intent rather than the end result (Unless you think (6)(i) would apply), since the intent of the taxpayer was not to manipulate this election for a tax benefit, my assumption is that they would be able to expense all of the items normally.Just looking for confirmation as I'm pretty confident my understanding of the regulation is correct.

It's easier to just park in the driveway, esp when the garage temps can be well over 100 degrees.For the right buyer, being able to generate $1500 / mo rent far outweighs the extra storage space.
