Hey there BP, I bring another case of emotional support animals being a nuisance in my investing career.

It is a constant nuisance that never ends.

You spent a lot of time & effort on rehabbing an upper apartment that I assume will pay higher mkt rents but get to enjoy the smoking as it permeates through the building & the dog howling.You need to eliminate this nuisance & then rehab that apartment to gain yet higher mkt rents.

If it does start smelling, it will be a legal nuisance to him.

You might find that the site will be classified as an "attractive nuisance", so be sure to follow the rule of the town and insurer so you don't get sued if a bunch of drunk teenagers get hurt in there.Good luck!
