Capital expenses can blindside you and knock you out the game with a bad taste in your mouth and sour you on real estate. 

Understanding the current schedule for any and all inspections and what they may entail will keep you from getting blindsided. 

We intend to foreclose on the property, but I'm posting here to see if anyone has any thoughts on downsides or blindsides that I'm not considering on this action, or if the person living in the property has any ownership rights from probate?

I would like to get this thing underway but don't want to jump in and get blindsided by anything.

It's amazing to me how many people purchase in an HOA, don't read all of the documents ahead of time, and then are shocked when they get blindsided by something.

I'm guessing the listing agent was blind sided as well and didn't order an O&E prior to putting it on the market?

I have had several people try to blind side me that way, but were never successful although I never took action to cloud title. 

This already has been a painful process, and now I get blindsided by this.

I am not saying, by any means, that all family will be that way and many will have your best interests at heart, but I got totally blindsided by someone I fully trusted and thought was helping by employing.
