It seems legislation effecting real estate investors is changing by the minute here in Colorado.

You'll just have to compete with well connected, very effective investors here as they move fast and usually are scooping up properties quickly. 

But if you think appreciation has stalled or capital expense might be lurking then a 1031 is better than just a sale because you get the compounding effect of the deferred tax working for you not the government.

That's not to say that they have no value...just that their are more cost effective ways to accomplish the same thing in most situations.
