(actus non facit reum nisi mens sit rea)If a bank intentionally foreclosures on the house of a person who it knows is current on his mortgage payment, or if it "forecloses" fraudulently on the wrong house knowing that it is the wrong house, then you are right that it would be a criminal matter under current laws.But if you are doing a million foreclosures and there are some paperwork errors that result in a few wrong foreclosures, it does not become a crime that is comparable to burglary, etc.

The only way you could argue this is that you can prove 100% beyond a shadow of a doubt the owner tricked you fraudulently.

I forget the name of the program, but basically it is designed to prevent the IRS from issuing a fraudulent refund after they inevitably receive fake tax filings next spring and it should keep your filing as the only one they actually process.

The only way to combat this is with a much lower purchase price, where your high cap rate and low basis can overpower the financing disadvantage, or with some type of supplemental financing.

Not an exact quote from numerous medical studies but more of a synopsis.BTW; just to brag a bit on myself (and say "bite me" to just about every authority figure in my schools, except my Senior year Guidance Counselor, here is a short history of me since '66.Drafted into military, ended up spending 9 years doing that, a couple of combat decorations, started my BS while in service at the urging of my Colonel who told me my talent would always be wasted in government service, finished my BS in about 30 months of starting, despite several extended TDY assignments.Held 5 jobs within the first 3 years after getting out of the service, and had started one company, later sold.10 years later I had 5 rentals and an MBA5 years later I had 10 rentals and had started a second company5 years later I had quit a job after 17 years that was paying pretty da** well, started a partnership (dissolved within 3 years) and had 16 rentals, all paid for, owned my own house free and clear.BTW, despite my stellar 1.3 GPA in high school I had a 3.7 in college and a 3.8 in graduate school.

Our names are not on the UD, apparently he provided the bank with a fraudulent rental agreement with another party since we had seen another name on some legal papers posted on our door a while back.Now the landlord wants to move into the rental house and kick us out (he is going to try to do a BK and other moves to further delay the process).He just gave us a 3 day notice to quit (we are in California) and he threatened us with a UD if we don't move in the next two or three days.I told him we would leave at the end of the month (less than 30 days) but he said we have to move out ASAP.
