I'm not sure about those State laws but I would try to get them on a new 12 month lease, possibly with an increase if it's warranted and if they wanted to stay MTM I'd still have them sign my lease so they have to adhere to my rules and I'd add a MTM rent premium.

IMO, the management company could have mitigated much of this damage if had they acted as I stated they should, that this is an emergency situation and warrants an emergency call to the plumber.

Maybe get an opinion from a qualified arborist, and also consider using such a person for your trees in the future, if you can afford it and if you find the value of your trees warrants it.
