I'm leaning towards letting it roll over to the month-to-month because she has been good tenant other than the few late rents.Other than being late, she has been a good tenant, no damage to the unit in my walk through a few months ago to replace the furnace filter.

You are going to be surprised at the accumulation of these figures and that surprise could be catastrophic to find out when you can't make a mortgage payment because you have a vacancy, have to replace the HVAC or you have an expensive tenant turn due to damage.

I would only do this if you can afford to have them live in the unit for free and can repair any damage they do out of your pocket - in other words, a purely philanthropic arrangement, where if they pay, all the better, but if they don't you wanted to provide the charity anyway.Otherwise, you should put this thought out of your mind and give yourself 5 good Moe slaps for even thinking the thought!

There are some damages, amounting to around $600, plus a fee of $250 for not leaving the property till day 3. ($100/day, and $50 for a half day.)

They are asking for mediation, even though its not their primary residence, and they have let a hole in the roof really damage the building, coupled with not paying taxes for years, we saved it from tax sale and asking our attornies to dismiss the frivilous mediation request, which has stopped our foreclosure in its tracks.So, its painful in judicial states, and less painful in states like AL & GA.

Waiting for the Marshal's office to call with the official date of the eviction and hoping that the tenants move out in the meantime, leaving a minimum of a mess and damage (a landlord can dream, can't they)?
