question for your lawyer...I would ensure the lease is being followed and that there are no history that would lead me. to believe it won't be followed.

Worst case scenario, you pay a lawyer $2,000 to serve and evict both tenants.

Would assume you cannot raise up to market level for existing tenants but agree you should check the ordinance/consult lawyer. 

If not, I don't think the cost of having a lawyer draft/review these documents are worth the benefits of locking up this one tenant (unless he or she is willing to pay a lot more). 

It sounds like you need a California RE lawyer to look over your lease, see if you have any way out.
