So, assuming a lender has no overlays and goes by the letter of the law, depositing a cash gift into your account and seasoning it for a full 60 days is not fraudulent and is something that is done on a regular basis for a reason because that's what the rules allow for.

Someone not buying under the LLC is typically doing so because it's cheaper/easier to get funding .... again otherwise they'd just buy under the LLC to start out with.The company's actions were wrongful or fraudulent.

Then get a few signatures on an application, secure a deposit and then vanish.Only after the money is gone do the potential buyer find out the person wasn't the real agent and the listing was fraudulent.

In addition, you should carefully consider the terms of any subscription agreement or other agreements you have to enter into for the investment.I can only speak for myself, but I think many of the other posters in this thread are trying to say the same thing- syndications in and of themselves are not a bad thing, nor are all syndicators bad or fraudulent. but you need to examine the track record and credentials of the sponsor team along with the terms of the deal

I wouldn't be so quick to remove a $50 under market value tenant who's been there for 8 years in favor of keeping a $50-more a month unknown entity.The seller's agent - if they were the one renting the property for the seller - should NOT be profiting from that transaction and making you scramble.And how dare they assume you would be using the FHA fraudulently?!?
