You are looking for a "Waiver of Subrogation" naming you as insured on his ACORD certificate (this would reflect his WC, GL, Umbrella, and etc), if it is real, then you should be off the lawsuit, if he made it up, then he is guilty of perjury.

like why is it on the landlord when it should be on the tenant isnt our system base on innocent until proven guilty?  

It's helped me not feel guilty making a "low ball" offer to an agent.  

Of course if you are putting in some work yourself, depending on your skill level you could drop that number drastically... though then you aren't accounting for paying yourself anything of course, which is what I tend to do to make the numbers work better in my favor, totally guilty on that one!
