My message here is to consider that even if you are right, you might have to pay to have a court confirm that fact, and you should consider (as you probably have) how much that will cost you along with the chances of recovery from the gc.

That said, the inventory (given we are near a decade into a recovery) is not full of people desperate to get out of a property.

They are readily aware that tax recovery amounts are significant in these areas, and given the increased focus on revenue recovery over general tax compliance I would conclude that this focus will only further intensify.

Im facing carpel tunnel surgery with a recovery time of maybe 3-6 months. 

Luckily my wife has been saving money for about 25 years so I am not under a bunch of stress because of my medical recovery and my wife's boss has been very kind about me.  

The Illinois Condominium Property Act allows the the HOA to recover up to 6 months of dues plus attorney fees and costs only if they file an action for recovery of dues.
