I think you mean forward funds recovered or due and not you try and take funds not claimed.To find folks that are hard to find, search for "skip tracing".In addition, most states of a lost or unclaimed property laws that needs to be adhered to.

I went through the lease and I found this paragraph in the lease.It is stipulated and agreed that in the event of the termination of this lease pursuant to (a) hereof, Owner shall forthwith, notwithstanding any other provisions of this lease to the contrary, be entitled to recover from Tenant as and for liquidated damages an amount equal to the difference between the rent reserved hereunder for the unexpired portion of the term demised and the fair and reasonable rental value of the demise premises for the same period.

@George Blower If I do a straight withdrawal and immediately up my 401k Withholding to 15% will whatever amount I put back in over the next 3 years be considered repaying the dispersement and I can thus recover the taxes paid?
