The Water Department still asks for the affidavit because they don't consider 'equitable title' ownership unless it's 'legal title'.....so I'm wondering if I can specify timely payments of the water bill in the LC as part of the performance of the contract (or would you recommend I put the water bill in my name on a Land Contract situation too?)

As long as the property is in good shape and is able to market itself in the event of a vacancy, then I think you've got a stable, good performing asset. 

I suspect your Walnut Creek unit to have performed far better than my worse appreciating property.  

Examine the causes of the vacancy, including any new developments or economic influences.

I haven't seen one apartment deal work. most are covered land plays for redevelopment. you can buy performing assets that sit on plots of land that can be upzoned.

Also to document and support a future suit for specific performance.
