Nevada is one of the strictest states in the US to loan money. you need a license.. there may be carve out but before you do this check with the state.penalties are harsh I made one comment on lending money in Nevada 18 months ago and got a nasty gram from the state.. :)secondary or Gap financing is HIGHLY risky..

Our seller had defrauded his purchase in the same manner, extorting some 40K as a second and destroyed their 1031.I send a nasty gram to the seller, his agent and my agent of the consequence of failing to close one time:suite for specific performance (aka complete the transaction)all tax liabilities attached to the 1031 would be sought as damages - - and that was 128k!!!

One reason I know about NV.. is I made one post on BP looking for a NV Mortgage broker to broker a few notes for me.. and I got a Nasty gram from the state of Nevada.. telling me they researched me they found I WAS NMLS licensed in ORegon but not Nevada and I could not do business in that state or originate any loans in any states if my company was based in Nevada.. this would require NV license..
