This process is called "Ejectment" not eviction. 

If he is squatting, you must file Ejectment proceedings (much different than Eviction).

That strategy will give the tenant-buyer equitable rights and when things go sideways will force you to do an ejectment--similar to a foreclosure--instead of a regular eviction. 

Absent that, go ahead and improve the property and hope the kids don't file suit for ejectment and disgorgement of unearned profits before day 3651.
