It would also typically say you can only bring a lawsuit in a certain county within a state (or say that the parties must arbitrate).

There is only one call-to-action button in their email UPGRADE which leads to acceptance of 2 new contracts. 1) Terms in which they introduce HYPERWALLET, as a replacement of YAPSTONE and enforcing some bad terms such as the authorization of "debit" (in addition to the normal "credit") into our bank accounts in a more formal way. 2) A new terms for HOMEAWAY/VRBO which among other things, removes hosts option to sue them in court (except for small claims), forces Arbitration and removes the ability for a class action.

I'm not saying you should do this (I don't know enough details to advise you either way, and I tend to fall in the @Chris Mason camp on this one), but if the listing agent is a REALTOR®, you could file an ethics complaint and request arbitration through their local Board of Realtors.

Disputes are handled through arbitration (read some past cases to see how biased the arbitrators are - who also have who knows what qualifications and you permitted to record the session.) and not the court.
