I guess we could maybe have the builder agree to the cost of the build and if we sell for more or less then the profits would go up and down based upon the selling price.

The one caveat being that when it comes time to sell or refinance one of the properties there may be a partial release clause, causing you to pay the bank back more (120%) than the original loan on that particular property.Happy to be a resource!

It also is helpful to have a California LLC in case you ever sell that property and move into another state so that you do not need to form a new LLC altogether with new operating agreement, just re-register in the new state as a new foreign LLC.
