It should be—make no mistake, there are many people who have “lost it all” making bad real estate investments, both from poor decision making and market forces.The primary difference is that in a syndication you can suffer a loss as a result of bad decisions and fraud by the sponsor in addition to the risks of loss present in direct investing.  

Turns out my awesome tenant that had been paying his cash 1 day early every month in $100 bills had setup a wire fraud and money laundering scheme out of my property and the authorities thought I was in on it.

Sounds like mortgage fraud.

It's expected and not usually penalized unless a competing offer of identical price has none. 

@Jeff George you still need to disclose that current mortgage and if you don’t that’s mortgage fraud

There is a chain of representations from the PSA, through the Buyer to the lender which can trigger fraud and other violations.
