I have spent a great deal of time in California, Arizona, Nevada, and other states working with various agents and attorneys only to conclude it is not clear cut.In my opinion, if your working with the a listed property, you need to be very careful becuase there are a lot of eyes watching agents right now becuase lawmakers tend to believe distressed homeowners need to be treated with a higher degree of protection.

Jon is 100% correct.As a Broker Investor I was challenged by my Board of Realtors and their attorney concluded the same thing Jon mentioned.To find a Cash Buyer I would put it on the MLS.
