You've basically just stated that you are wanting to buy it with the express intent of it not being your primary residence which is pretty much the number 1 requirement of an FHA loan (and you did so using a profile with your full name listed).

@Shaun Weekes I thought I did answer the question in that I only expressed an interest in selling. it could rent for 7500/8000, however a refi with P&I plus taxes and insurance would cost 8/9k monthly.

If not or express that they won't, then you can serve them with a Notice to Vacate or...if after the timeframe is up for the new addendum...a Cure or Quit notice if they are still using the fireplace.Though, for fireplaces, I wouldn't even get into all that.
