Saying I did (extreme damage to the property and regardless to the terms of the note and mortgage I should be held liable personally, pay attorney fees, and any amount that was still owed after the foreclosure sell.

To clarify, the deposit is still held in escrow at the moment, however, as the contract reads, the deposit should have been released to me upon seller’s receipt of my election to terminate the contract during the DD period.

Title can be held by anyone, but the lien won't change.As far as "due on sale", the contract doesn't say it's automatic...it says the lender has the right to call the property due.

I've done 3 deals, my first one I worked alongside a mentor he held my hand through the whole deal and took over towards the end because I still didn't know or had experience dealing with banks, the other two I did on my own where I put up the Ernest and Option money and sent the contract off to title and I didn't even have to do a double closing because both my Seller and Buyer knew from the get-go what I want for providing my services and I'm all about fair deals, I hoenstly see wholesaling as a necessary evil.
