There could potentially be some clauses listing reasons why you could move sooner?

Different lenders/banks have different seasoning periods--i.e. the amount of time you must wait from the original purchase in order to refi--but it more than likely will not have to be 2-3 years if you have the equity available sooner. 

I wish I had done it sooner.

That way I can say, "no, but here's what I can workout with you if you wanted one sooner..."

I would think sooner or later as joint owners you would need to file something.
